Strength, Compassion, and Lived Understanding — Kathryn Smithen Family Lawyer

Why Smithen Family Law?

We exist to guide, protect, and uplift you through the most painful and uncertain moments of life.

Smithen Family Law was founded on the belief that legal representation should do more than resolve disputes, it should help people rebuild. Drawing from lived experience and a deep understanding of trauma, we approach every case with empathy, strategic clarity, and unwavering protection. Here, your story is heard, respected, and supported with the dignity and compassion you deserve.

Lived Experience, Legal Expertise

The Rare Combination That Changes Everything

There are hundreds of family law lawyers in Toronto. Very few can offer what Kathryn does: the rare combination of deep legal expertise, genuine lived experience and a caring and individual approach to your case.

Kathryn has practiced family law for over fifteen years, mastering the statutes, regulations, and case law that govern separation, divorce, custody, support, and property division in Ontario. She applies the Family Law Act, the Divorce Act, the Children’s Law Reform Act, the Spousal Support Advisory Guidelines (SSAG), and the Federal Child Support Guidelines with precision and strategic insight to each client’s situation.

But legal knowledge alone does not comfort a mother who fears losing time with her children. Legal acumen does not support a mother who has been worn down by years of intimate partner violence. Kathryn has lived both experiences personally and professionally. Kathryn’s lived experience allows her to meet clients where they are, not just as a lawyer, but as someone who truly understands the emotional weight of what they are carrying.

Recognized in Canadian Media

A Trusted Voice in Family Law

Kathryn’s voice is trusted well beyond the courtroom. She has been featured in Maclean’s magazine, the Globe and Mail, the Toronto Star, and Law Times — Canada’s most respected publications turn to her for expert commentary on family law matters.

This media recognition signals something important: Kathryn is a respected source of information in her field (worried about the use of the word “authority”). When journalists need clarity on complex legal issues, they call her. That same authority and clarity are what she brings to every client conversation and every court or mediation appearance.

Kathryn has been called on by Members of Parliament to appear as a witness on Justice issues relating to intimate partner violence.

A Trauma-Informed Approach to Family Law

Family Law Is Not Like Other Areas of Legal Practice

Family law is not like other areas of legal practice. The people walking into a family lawyer’s office are often traumatized and emotionally exhausted. They may have experienced infidelity, financial abuse, physical or emotional violence, or the slow unravelling of a partnership they once trusted.

Kathryn’s practice is built on a trauma-informed foundation. Every interaction is designed to prioritize the safety, dignity, and autonomy of the client and their children. She never rushes a client. She never minimizes their experience. She never diminishes the importance of listening to their personal stories. She listens patiently and validates their feelings. She explains the law in plain language, presents options clearly, and helps her clients make informed decisions. Kathryn is always focused on restoring a sense of control and empowering the client at a time when everything feels chaotic.

The Principles Behind Every Case

Three Principles Guide Every Matter Kathryn Takes On

INTEGRITY

Kathryn tells her clients the truth — even when it is difficult. She does not make promises she cannot keep. She provides honest legal assessments so her clients can plan with clarity and, most important, know what to possibly expect in their family law case.

DIGNITY

Every client deserves respect, regardless of their financial situation or background. Kathryn’s practice welcomes women from all walks of life, including high-income and impecunious women.

STRATEGY

Compassion does not mean being passive. Kathryn is a fierce advocate who thinks several moves ahead. She builds cases methodically, is exhaustive in her approach, negotiates from strength, and litigates when necessary.

Built on Lived Experience, Backed by Legal Expertise

Her journey through trauma, loss, rebuilding, and profound personal change gives her an understanding of family law that few lawyers ever develop. She knows what fear feels like, what uncertainty does to a person, and how heavy it is to protect yourself and your children alone.

That lived truth guides her to meet every client with empathy instead of judgment, clarity instead of confusion, and strength that never intimidates. Kathryn offers more than legal representation. She provides reassurance, stability, and the sense that someone finally stands with you, not against you.
